Some XRP holders sue apple for Fraud and negligence proving again that the level of organization displayed by the Ripple community so let’s find out why in our latest Ripple news.
According to a Class Action Complaint filed earlier in September, a few XRP investors accused Apple of allowing malicious actors to steal their assets and information. The action was filed by Hadona Diep as cybersecurity IT professional on behalf of other XRP holders in a similar situation in a federal court of Maryland. The plaintiff sought compensation for damages stipulated under the federal and state US laws according to the documents shared by the Court House News. Some XRP holders claimed that apple breached the law by authorizing malicious applications to be available for download in the App store and they also alleged that the company was aware of criminal activity enabled by teh app while still maintaining it without notifying the users that their financial information was compromised.
The app was called “Toast Plus” and was used by bad actors as a part of a phishing scam. The name and the logo of the app imitated that on the Toast Wallet and it only confused the users and stole their funds. The XRP holders decided to use the description of the app in the store as a part of their class action. The tech giant described their application provider as follows over the past 10 years:
“a safe and trusted place to discover and download apps. But the App Store is more than just a storefront — it’s an innovative destination focused on bringing you amazing experiences. And a big part of those experiences is ensuring that the apps we offer are held to the highest standards for privacy, security, and content. Because we offer nearly two million apps —and we want you to feel good about using every single one of them.”
XRP holders argued that the tech giant had a very long verification process for the apps offered on the provider. One user named Hadona Diep downloaded the Toast Plus to her iPhone and linked her private keys for 474 XRP to the wallet of over $400 at the time of writing. The document claimed that she intended to hold her funds as an investment so she stopped checking the app until August 2021. She then realized that her account was deleted and the funds were stolen. Diep contacted Apple and other agencies in the US and the class action charged 9 against Apple. The plaintiffs are looking for statutory damages of over $10,000.
