BitClout Was Hit With Cease-And-Desist Order By Law Firm

Bitclout was hit with a cease-and-desist order by the Anderson Kill P.C Law firm that represents Brandon Curtis who was a product lead at the Radar Relay company, as we read more in our latest cryptocurrency news today.

BitClout was hit with a cease-and-desist order after the platform allegedly used Curtis’ likeness without his consent. The law firm sent a letter to Nadar Al-Naji who reportedly breached California’s civil codes. BitClout is a social media network that issues “Creator coins” corresponding to different users and the platform seems to use these profiles from Twitter regardless of the users actually agreeing to it.

The cease-and-desist letter is the latest addition to the tale of BitClout which is seemingly a controversial project with founders under pseudonyms. While one of these founders under the handle Diamondhands claims that BitClout offers a new way of monetizing a social following, others balked at other aspects of the rollout like the inability to trade out of the BTCLT token once purchased. The law firm didn’t specify how it tied Al-Naji to Bitclout but only wrote that it is a project  “a project that we understand was launched by you and is under your control.”

The founder of the decentralized finance startup Summa James Prestwich, also claimed that Al-Naji is behind BitClout as of personal knowledge. The lawyers also continued:

 “It is well established that a person or company cannot knowingly use another’s name, voice, signature, photograph or likeness, in any manner … for purpose of … selling, or soliciting purchases.”

They stated that if any person found in violation of the code is liable to pay up to $750 or damages incurred by the alleged actions for the unauthorized use of the identity of a person as well as any profits collected in these actions:

he would need to put his own money into your project or provide … personal information. Even messaging BitClout’s support team costs BitClout tokens. Mr. Curtis has no contractual relationship of any kind with you nor any desire to form one.

One of the lawyers that signed the letter asked the company to remove his profile from the platform which the company did but another lawyer, Hailey Lennon stated:

“The right of publicity means an individual should be able to decide how they profit from the commercial value of their likeness and what organizations they collaborate with.”
