The docket title is “Amendments to Broker-Dealer Financial Responsibility and Recordkeeping and Reporting Rules Regarding Crypto Assets.”
The pending Executive Order 12866 review page lists that received date, names the Securities and Exchange Commission as the agency, classifies the stage as a proposed rule, and marks the item as economically significant.
There is no legal deadline, and the draft text is unpublished.
For anyone following bitcoin regulation, the useful fact is this: the filing asks how four long-standing broker-dealer safeguards should apply to crypto assets, including Bitcoin.

The matching Unified Agenda entry for RIN 3235-AN48 keeps the item at the proposed-rule stage.
The agenda abstract says the Division of Trading and Markets “is considering recommending that the Commission amend Rules 15c3-1 and 15c3-3 and other broker-dealer financial responsibility rules, as well as Rules 17a-3 and 17a-4, to address the application of these rules to crypto assets.”
Legal authority is listed as Exchange Act sections 15(c) and 17(a). The agency contact is Raymond Lombardo of the Division of Trading and Markets at 100 F Street NE, Washington, DC 20549.
The timetable still shows a notice of proposed rulemaking dated July 2026. As of our November 8, 2026 review, the item remained under pending EO 12866 review rather than appearing as a published proposal.
The Four Broker-Dealer Rules Named in the Agenda
The four cited provisions already govern U.S. broker-dealers.
A 2013 SEC summary of those financial responsibility rules describes Rule 15c3-1, the net capital rule, as requiring more than a dollar of highly liquid assets for each dollar of liabilities, so a failed firm can pay customers.
The same summary describes Rule 15c3-3, the customer protection rule, as requiring a firm that holds customer securities and cash to keep those assets separate from its own proprietary business.
Rules 17a-3 and 17a-4 require broker-dealers to make and keep specified business records so firms can account for their activity and regulators can examine them.
The current net capital rule in the eCFR also sets activity-based floors. A broker-dealer that carries customer or broker-dealer accounts and receives or holds funds or securities for those persons must maintain net capital of not less than $250,000, unless another paragraph applies.
None of that tells us how the unpublished draft would treat Bitcoin haircuts, custody, or crypto-specific recordkeeping. It only tells us which parts of the existing rulebook the Division wants to adapt.
What the Pending SEC Crypto Rules Do — and Do Not — Say
The honest limitation is the most important one: OIRA’s listing is a process fact, not a public proposal.
We cannot claim the draft would loosen capital charges, tighten them, bless a particular custody model, or rewrite how Bitcoin is booked on a broker-dealer’s balance sheet.
“Economically significant” is not a verdict on Bitcoin’s price. It is OIRA’s designation that the proposal warrants review under Executive Order 12866 because of its expected economic impact.
A proposed-rule stage item still has to be published, opened for comment, and later adopted before it changes anyone’s legal duties.
Still, the direction of travel is constructive for bitcoin regulation and for crypto market structure. Spot Bitcoin already reaches public-market investors through regulated intermediaries.
Clearer instructions on capital, customer protection, and records would help those intermediaries handle crypto assets with less guesswork. We believe clarity of that kind supports broader participation without promising a particular return.
Bitcoin’s Path Around the Filing Date
The price path around that date does not prove the filing caused the move.
CoinGecko data retrieved on November 8, 2026, at 17:26 UTC put Bitcoin at $75,654.84, with a 24-hour range between $75,541 and $76,106 and a change of about 0.1% lower on the day.
That is about 18.4% above the August 11 reading of $63,916, 12.6% below the September 22 high of $86,596.74, and 40.0% below the October 6, 2025, all-time high of $126,080. Market cap at the snapshot was about $1.52 trillion.
From the November 3 daily price of $76,709.41, Bitcoin was about 1.4% lower by the snapshot; from November 5’s $80,442.71, about 6% lower. We read those swings as ordinary two-sided trading, not as a scorecard for an unpublished draft.
What Investors Should Watch After This Review
This SEC filing is not the only Washington crypto item on a formal docket this week, and the files should not be blended together.
As we covered when the Labor Department sent a crypto 401k rule for White House review, that document answers a retirement-plan question and expressly names Bitcoin. The SEC item is about broker-dealer capital, customer protection, and records.
Separately, we noted that the crypto travel rule threshold remains $3,000 after a related proposal was withdrawn. Those are distinct rulemakings inside the broader debate over U.S. crypto market structure.
The next hard fact to watch is publication. If OIRA completes review and the Commission issues a notice of proposed rulemaking, the amendments themselves will finally be readable, and a comment period would follow.
Until that happens, we would not treat RIN 3235-AN48 as a finished chapter of bitcoin regulation. We would treat it as evidence that the SEC is trying to fit crypto assets, Bitcoin included, into the same customer-protection architecture that already governs traditional brokerage.
For us, the encouraging part is simpler: Bitcoin needs clear instructions for the regulated rails around it. The coming weeks will show whether this review becomes a public proposal that preserves those net-capital and segregation principles.
